Article 1 - Applicable Regulations

This contract is subject to the French Status of Tourism Residences. The occupant can not, under any circumstances, declare his principal residence at 514 Appart Hotel. The occupant can not prevail any applicable legal provisions on residential leases, especially with regard to tenure. Domiciliation in the residence, private or professional, is prohibited.

Article 2 - Booking

The booking of an apartment is only valid after validation of the 514 Appart Hotel. The booking confirmation remains to the fully discretion of 514 Appart Hotel.

Moreover, the reservation has to be guaranteed by a valid credit card issued by a valid reputable institute, by a credit agreement with 514 Appart Hotel, or be followed by a deposit.

In the case of a deposit, this one must correspond to 1 night for a stay less than 7 day(s), 4 nights for a stay between 7 to 29 nights and 10 nights for a stay superior to 30 nights. Reservations validated by 514 Appart Hotel and subjected to a deposit (or guarantee) will be kept at least 30 days before the first day of arrival. In case of non or failing payment of this deposit within 30 days before arrival, the reservation will be automatically cancelled.

Bookings made less than 30 days before the date of arrival must be guaranteed with a valid credit card issued by a valid reputable institute. 514 Appart Hotel reserves the right to do a pre authorization on credit card before the arrival for any stay.

Article 3 – Payment

Invoices must be pay immediately on presentation. The day of the client arrival, 514 Appart Hotel will charge the entire length of the stay, except for stays longer than 30 days which invoices are issued and presented every 30 days.

In case it was agreed that the payment of the stay of a resident would be done by a third party, the resident/occupant will remain personally responsible for the payment.

Payment for all optional services will be required on presentation of the corresponding invoice. The credit accepted by 514 Appart Hotel for this type of service is 100€.

514 Appart Hotel will have a monthly interest of 1.5% on any amount not paid on its due date.

Article 4 - Price

Our prices are in Euros and include all taxes and include VAT at the current rate.

All changes to the current VAT rate or new taxes on the services provided, which occurred between the modification/creation and the billing, implies by right a modification of the price including all taxes. The price does not include the city tax payable locally. Some additional services are not included in the price (see public grid tariffs displayed).

Our prices always include unit rental, water, electricity, heating, air conditioning, Wi-Fi and rental charges.

Article 5 – Booking and length of stay modifications

Subject to availability and at the discretion of 514 Appart Hotel, the length of stay can be extended without the maintain obligation in the same apartment or at the same price. Any stay started, interrupted or shortened do not give any refund. Any changes to a reservation made through a partner (especially on the Internet) must be changed only by the partner.

Article 6 - Cancellation / Non arrival

If cancellation

Any cancellation received after 12 hours, the day before the expected date of arrival will be subject to a cancellation fee equal to:

• One night: for stays less than 7 nights.

• Four nights: for stays between 7 and 29 nights,

• Ten nights: for stays of 30 nights or more.

The applied price will not be proportional to the original booking but will correspond to the price of "individual night" during the time of cancellation according to the different seasons (see public tariffs displayed). In case of written cancellation, the effective date of the cancellation will be the date of the mail reception at the residence. Cancellations from reservations made through a partner (especially on the Internet) must be cancelled by the partner.

In case of non arrival

The booking client, which does not present the day of the arrival date will be subject to compensation equal to:

• One night: for stays less than 7 nights.

• Four nights: for stays between 7 to 29 nights,

• Ten nights: for stays of 30 nights or more.

The applied price will not be proportional to the original booking but will correspond to the price of "individual night" during the time of cancellation according to the different seasons (see public tariffs displayed).

Article 7 – Client Duty

The apartment will be available to the resident in good condition. The resident will use the apartment and its installations and undertake to respect and not to degrade places.

An inventory is in each apartment. The resident has to check its accuracy and quality on arrival and notify reception of any anomaly, missing or damaged items, within 4 hours of arrival. On the departure of the resident, the inventory and the cleanliness of the apartment will be subject to review by the manager of the 514 Appart Hotel, and any missing inventory or damage caused to the apartment will be charged to the resident (see table of replacements).

514 Appart Hotel reserves the right to enter in the rented apartment for maintenance or safety.

Each apartment is estimated for a maximum number of occupants can not be occupied by a greater number of people. Children are considered as occupying its own. Any excess will be denied.

514 Appart Hotel is not suitable for collective stays or individual stays away from home for minors less than 18 years old, not accompanied by their legal administrators. 514 Appart Hotel reserves the right to refuse access to apartment and to cancel reservation for minors less than 18-year-old which booked without considering this article.

Article 8 – Liability

The liability of 514 Appart Hotel could not be committed in case of theft or damage to personal effects in the apartments, including in individual safe box, common areas, parking spots and any other outbuildings or annexes of the complex: this accommodation agreement is subject to the French Status of Tourist Residences, therefore the articles 1952 and following the Civil Code in regards to hoteliers are not applicable.

The 514 Appart Hotel will not be responsible for the disturbances that would disturb, stop or prevent your stay in case of natural disaster or exceptional events as for example, droughts, floods, oil spills, general cut-off of electricity, gas, or water, strikes, exceptional work etc.

Article 9 - Cancellation - Penalties - Non-renewal

The contract will be automatically cancelled without formality and without delay, in case of failure by the resident of any of its obligations or inappropriate behaviour that may disrupt the comfort or tranquillity of other occupants. The resident must leave the residence immediately and can be evicted if necessary with the assistance of the local authorities.

Article 10 - Respect for private life

Regarding the "Data Protection" law, the resident has a right of access, rectification and opposition to personal data. To do this, simply make the request by writing, without cost other than that request sending 514 appart hôtel 7 chemin de Montlegun la cité 11000 Carcassonne.
